The protection of your personal data is very important to us. We want you to feel safe when visiting our website. Therefore, we process personal data in accordance with the current legal provisions, in particular in terms of the EU General Data Protection Regulation (GDPR).

In the following, we inform you about the type and scope of the processing of personal data when using our website, the online shop at www.lehmann-natur.com and other services offered by us (“Services”) as well as the rights to which you are entitled with regard to this data. “Personal data” in this context means all information relating to an identified or identifiable natural person, e.g. name and email address, but also your customer number. Processing means, for example, the collection and storage of this data. Finally, we will explain how we comply with the legal provisions on data protection, in particular the General Data Protection Regulation (“GDPR”), the Federal Data Protection Act (“BDSG”) and other applicable regulations, and how we protect your data from unauthorised access by third parties.

3. Data security

We secure our website and other systems through technical and organisational measures against loss, destruction, access, modification or distribution of your data by unauthorised persons.

In connection with accesses to our website, primarily technical data that may allow identification (e.g. IP address) is temporarily stored on our servers for the purposes of data and system security, but in principle for no longer than 30 days. The processing of this data for the purposes of data and system security is based on Art. 6 (1) (1) lit. f) GDPR and our legitimate interest in securing our systems and preventing misuse.

 

4. Processing of data in the application procedure

We collect and process the personal data you provide for the purpose of processing the application procedure. The personal data you provide voluntarily includes, for example, title, first name, surname, email address, address, certificates, curriculum vitae, letter of motivation, photograph, etc. This data is collected and processed exclusively for the purpose of reviewing your application and initiating an employment relationship. The legal basis for this is Art. 88 (1) GDPR in conjunction with Section 26 BDSG (new) and Art. 6 (1) p. 1 lit. a) and lit. b) GDPR. We do not ask you to provide special categories of personal data unless required by law. If you provide us with personal data, you hereby expressly consent to the processing of such data as described herein.

Personal data is not passed on to third parties or transferred to third countries. We store your personal data for the duration of the application process. If the application is unsuccessful, the data you have submitted will be deleted no later than six months after notification of rejection, provided that no other legitimate interests prevent deletion or your consent has been given for storage beyond this. If an employment contract is concluded, you will be informed separately about the further use of your data.

 

5. Use and disclosure of personal data

Personal data is only collected if you provide it to us voluntarily. We collect, process and use personal data, such as name, address or email addresses of visitors to the website, without further consent only insofar as they are necessary for the establishment and processing of the contract.

We will only share your personal information with third parties if:

  • you have given your express consent in accordance with Art. 6 (1) p. 1 lit. a GDPR,
  • the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f GDPR for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • there is a legal obligation for the disclosure according to Art. 6 (1) p. 1 lit. c GDPR,
  • this is legally permissible and necessary according to Art. 6 (1) p. 1 lit. b GDPR for the processing of contractual relationships with you.

 

B. Visiting our website, cookies

When using our website for information purposes only, i.e. if you do not shop in our online shop, do not use any other services by entering your personal information (e.g. newsletter registration) and do not otherwise provide us with personal information, we may nevertheless collect personal data that your browser automatically transmits to us. Details on this can be found below under Item 1.

In addition, we use various technical tools for the purposes of web analysis, to compile statistics and to support online marketing. Further information on this and also on the use of cookies can be found in Items 2 and 3 below.

 

1. Collection and storage of personal data when visiting the website

When you access our website, the browser used on your terminal device automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

  • Host name of the accessing computer

The above data will be processed by us for the following purposes:

The legal basis for data processing is Art. 6 (1) p. 1 lit. f GDPR. Our legitimate interest follows from the data collection purposes listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

2. Statistics, web analysis, marketing, personalisation

We create pseudonymised user profiles based on your use of our website for the purposes of advertising, market research and the needs-based design of the online offering. Further information on this, in particular on the use of cookies and cookie-like technologies, can be found in Items 3 and 4 below. The usage profiles are not merged with data about the bearer of the pseudonym.

3. Cookies und Cookie-like technologies

Our website uses cookies. Cookies are small text files that are placed and stored on a computer system via an internet browser.

Numerous websites and servers use cookies. Cookies often contain a so-called cookie ID. Such an ID is a unique identifier of the cookie and consists of a string of characters by which websites and servers can be assigned to a specific internet browser in which the cookie was stored. Via such cookies, it is possible to distinguish your individual browser from other internet browsers that contain other cookies. A specific internet browser can therefore be recognised and identified via a unique cookie ID.

Through the use of cookies, we can provide you with more user-friendly services that could not be realised or could only be realised to a limited extent without the cookie setting. Cookies enable us to recognise the users of our website. The purpose of this recognition is to make it easier for users of our online offer to use it. An illustrative example is the shopping basket function in the online shop, for which a cookie is used to ensure that the shop remembers the items placed in the shopping basket by the user in order to be able to sell them.

Category 1: Functional services

Functional services ensure functions without which you cannot use our website as intended. Below you will find a more detailed description of the individual services:

The tracking measures listed below and used by us are performed on the basis of Art. 6 (1) p. 1 lit. f GDPR. With the tracking measures used, we want to ensure a needs-based design and the ongoing optimisation of our website. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

a) Google Analytics

For the purpose of demand-oriented design and continuous optimisation of our pages, we use Google Analytics, a web analysis service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, pseudonymised usage profiles are created and cookies (see under Item 3) are used. The information generated by the cookie about your use of this website, such as your

  • Operating system used,
  • Referrer-URL (the page visited before),
  • Host name of the accessing computer (IP address),
  • Time of the server request,

are transferred to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services associated with the use of the website and the Internet for the purposes of market research and the design of these Internet pages in line with requirements. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymised so that an allocation is not possible (IP masking).

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this, you may not be able to use the full functionality of this website.

You are also able to prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=de).

As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent Google Analytics from collecting data by clicking on this link. An opt-out cookie will be set to prevent future collection of your data when visiting this website. The opt-out cookie is only valid in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must once again set the opt-out cookie.

b)      Google Adwords Conversion Tracking

In order to statistically record the use of our website and to evaluate it for the purpose of optimising our website for you, we also use Google Conversion Tracking. In the process, Google Adwords sets a cookie (see Item 8) on your computer if you have accessed our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords client’s website and the cookie has not yet expired, Google and the client can recognise that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. Cookies can therefore not be tracked via the websites of Adwords customers. The information collected using the conversion cookie is used to create conversion statistics for Adwords customers who have opted in to conversion tracking. Adwords clients will learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information with which users can be personally identified.

If you do not wish to participate in the tracking procedure, you can also refuse the setting of a cookie required for this – for example, by means of a browser setting that generally deactivates the automatic setting of cookies. You can also disable cookies for conversion tracking by setting your browser to block cookies from the domain“www.googleadservices.com”.

5. Notes on the use of social networks

Insofar as we offer links to external social networks on our website, these are identified, for example, as logos or with the addition of the “Like”. If these links are followed by a click, plug-ins are usually activated and your browser establishes a direct connection with the servers of the respective social network. If you follow these links and register there, the information that you have been on our website will be forwarded to the respective social network. As a rule, the social network operator can assign the visit to our website to your account and store it on web servers abroad. We have no influence on the scope of data collection, the processing of your personal data by the social networks and your rights on social networks.

This transmits to the server which website you have visited. In addition, the IP address of the browser of the end device of the visitor to this website is stored by Google. C. Use of our services (online shop, newsletter, etc.)

Personal data is collected and processed if you provide it to us when using our services, for example when placing an online shop order, registering for the newsletter or sending an enquiry to our customer service (via email to shop@lehmann-natur.com). Below you will find a description of the services we offer and the associated processing of personal data.

 

1. Orders in the online shop

The supplier and contractual partner for orders in the online shop with shipping to your home is Lehmann Natur Gesellschaft zur Erzeugung und zum Vertrieb ökologischer Produkte mbH.

If you would like to order in the online shop, it is necessary for the conclusion of the contract that you provide your personal data, which we need for the processing of your order. Mandatory information required for the processing of contracts is marked separately, other information is voluntary. We process the data you provide to process your order. The legal basis for data processing for the purpose of order execution and order processing is Art. 6 (1) (1) lit. b) GDPR.

In the case of orders placed via our website, we are obliged by commercial and tax law to store your address, payment and order data for a period of ten years. The legal basis for the corresponding data processing is Art. 6 (1) (1) lit. c) GDPR. However, we generally restrict processing after two years, i.e. your data will only be used to comply with legal obligations, unless processing of your personal data is necessary for other purposes and is covered by another legal basis in this respect (e.g. for carrying out the continued dispatch of a newsletter to which you have subscribed, etc.).

 

2. Newsletter

On our website you have the possibility to subscribe to the free newsletter of Lehmann Natur Gesellschaft zur Erzeugung und zum Vertrieb ökologischer Produkte mbH. The newsletter informs you about current offers, new products, special promotions and exclusive savings with regard to goods from our range. Furthermore, we use the newsletter to inform you from time to time about ongoing surveys and to ask for your opinion about our services.

All you need to do to register is enter your email address. For a personal address, you can voluntarily provide us with your title, first name and surname as well as your date of birth. After sending the registration form, you will receive a confirmation email from us (double opt-in email). The registration for the newsletter only becomes effective once you have clicked on the link in the confirmation email. If you do not click on the link in the confirmation email, the registration will not be completed. If you do not confirm your registration within 30 days, the information provided during registration will be automatically deleted.

You can revoke your consent for the newsletter service at any time with effect moving into the future and unsubscribe from the newsletter. For this purpose, you can use the unsubscribe link provided at the end of each newsletter email or contact us using or stating your email address registered for the newsletter; for this purpose, please use the contact details provided in this data protection declaration or in the imprint at www.lehmann-natur.com. Your email address will then be deleted from the newsletter distribution list. The revocation of your consent does not affect the lawfulness of the processing carried out on the basis of the consent up until the revocation.

Finally, we would like to point out that we may store your IP addresses and times of registration and confirmation. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data. The legal basis for this data processing is Art. 6 (1) (1) lit. f) GDPR and our legitimate interest in preventing unauthorised access or attacks on our services and the fulfilment of verification obligations.

 

D. Market and opinion research

We use the personal data transmitted to us in the context of the use of our services or otherwise coming to our knowledge in pseudonymised or anonymised form for our own market and opinion research. We expressly reserve the right to anonymise the aforementioned data accordingly. The legal basis for the processing is Art. 6 (1) (1) lit. f) GDPR, whereby our legitimate interest lies in the analysis and optimisation of the product range.

We also use address and order data for our own marketing purposes, such as personalised direct advertising and market research. In this respect, you can, for example, receive information about special offers and discount campaigns from Lehmann Natur Gesellschaft zur Erzeugung und zum Vertrieb ökologischer Produkte mbH by post.   • Right to data portability

The collection of data for the provision of the website and the storage of log files are absolutely necessary for the operation of the website. They are therefore not based on consent under Art. 6 (1) (a) GDPR or on a contract under Art. 6 (1) (b) GDPR, but are justified under Art. 6 (1) (f) GDPR. The requirements of Article 20 (1) of the GDPR are therefore not fulfilled.

Our competent supervisory authorities mediate on request in disputes, e.g. on the occasion of a fee invoice or the non-issuance of documents, between members of the Chamber and their clients. In this case, it is a mediation process. We do not participate in other mediation procedures.
